The Application
1The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal dated May 23, 2007 to review an application for a liquor licence from 1398096 Ontario Ltd., the "Applicant", for an indoor capacity at BLUE NITES SPORTS BAR, 1136 College Street, Toronto, Ontario, M6H 1B6, establishment number 802458, the "Premises". A hearing of the Application was held on July 3, 2007 in the City of Toronto.
2Carlos Almeide and Fernando Mariano are the principals of the Applicant. They appeared on behalf of the Corporation and waived the right to be represented by a barrister and solicitor or a licensed representative.
3The Applicant advised the Board that it wished to withdraw the Application.
4Registrar's representative consented to the withdrawal of the application and advised the Board that under the circumstances, the Registrar would withdraw the Notice of Proposal ("NOP") on a "without prejudice" basis but if a new application is received in the future, the NOP could be re-issued.
Decision
5In the circumstances, the Board ACCEPTS the withdrawal of the Application by 1398096 Ontario Ltd., intending to operate as BLUE NITES SPORTS BAR, 1136 College Street, Toronto, Ontario, M6H 1B6.
