The Application
- The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal dated March 28, 2007, to review an application dated January 25, 2007, from Maria Erzsebet Horvath, the “Applicant”, for a liquor sales licence at Europe Bar and Restaurant, 3030 Bathurst Street, North York, Ontario, M6B 3B6, Establishment number 812550, (the “Premises”). The Application was heard on May 15, 2007, in the City of Toronto.
Decision
- After considering all the evidence and submissions the Board approves the Application made by Maria Erzsebet Horvath for a liquor sales licence at Europe Bar and Restaurant, 3030 Bathurst Street, North York, Ontario, M6B 3B6, Establishment number 812550, based on the following condition as agreed to by all parties:
“That all sales of alcohol both inside and on the patio of the establishment cease at 9 p.m. and all evidence of alcohol services be cleared by 9:45 p.m.”
Reasons for these findings follow.
Preliminary Matters
Sujin Chan, appeared on behalf of the Registrar.
Ms. Maria Horvath is the Applicant. She appeared on her own behalf and waived her right to be represented by a barrister and solicitor or a licensed representative.
Mr. Ray Kallio appeared on behalf of the City of Toronto. The City opposes the application. On consent of all parties, the Board ordered the City be made a party to the proceedings.
Mr. Kallio advised the Board that a settlement had been reached between the parties.
The City removed its objection to the issuance of a liquor licence to Europe Bar and Restaurant with the condition that alcohol service cease at 9 p.m. and all evidence of liquor service be cleared by 9:45 p.m.
The Applicant agreed to the conditions as stated by the City.
Order
For the above reasons the Board APPROVES the Application for a liquor licence made by Maria Erzsebet Horvath for premises operating as or intending to operate as Europe Bar and Restaurant, 3030 Bathurst Street, North York, Ontario, M6B 3B6, Establishment number 812550.
The Board ORDERS that the following conditions be attached to the licence:
“That all sales of alcohol both inside and on the patio of the establishment cease at 9 p.m. and all evidence of alcohol services be cleared by 9:45 p.m.”
