AND IN THE MATTER OF THE LIQUOR LICENCE OF NITE FALLS INC. OPERATING AS DRAGONFLY NIGHT CLUB, 6380 FALLSVIEW BLVD, NIAGARA FALLS, LICENCE NO. 811773
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario ("AGCO") held a pre-hearing conference on May 11, 2007 pursuant to a Notice of Proposal dated February 7, 2007 to suspend a licence issued to Nite Falls Inc. operating as Dragonfly Night Club, 6380 Fallsview Blvd. Niagara Falls, Ontario, L2G 7X5, licence no. 811773;
AND WHEREAS the Registrar's Representative, Bryna Kaplan, and the Corporate Licensee's Representative, Jerry Levitan, were both present and participated in the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing July 26, 2007;
THEREFORE the Board hereby ORDERS as follows:
The corporate licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness' evidence, and specifically any surveillance tapes of the incidents alleged, if available, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar's Representative will complete any further disclosure, and in particular, any surveillance tapes of the incidents alleged in the Notice of Proposal, if available, also pursuant to Rule 7.4., ten (10) days before the hearing date.
