AND IN THE MATTER OF THE LIQUOR LICENCE OF 814888 ONTARIO INC. OPERATING AS PHOENIX THEATRE (THE), 410 SHERBOURNE STREET, TORONTO, LICENCE NO. 22881
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on April 20, 2007 pursuant to a Notice of Proposal dated January 29, 2007 to suspend a licence issued to 814888 Ontario Inc. operating as Phoenix Theatre (The), 410 Sherbourne Street, Toronto, M4X 1K2, licence no. 22881;
AND WHEREAS the Registrar was represented by its counsel, Phillip Morris and the corporate licensee was represented by its counsel, Flavio Battiston;
AND WHEREAS these matters are scheduled for a hearing commencing May 25, 2007;
THEREFORE the Board hereby ORDERS as follows:
- The corporate licensee shall disclose to Registrar’s Counsel pursuant to Rule 7 of
AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses, any witness statements in the possession of the licensee and a summary of each witness’ evidence with respect those witnesses for which statements are not available, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
Registrar’s counsel will provide a typed copy of Detective Burns handwritten notes which had previously been provided in the disclosure package as soon as possible and in any event, no later than 10 days before the hearing date;
Registrar’s counsel will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
