O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) has scheduled a hearing to take place on April 23, 2007, in Hamilton, pursuant to a Notice of Proposal dated December 11, 2006 to revoke the patio portion of the licence issued to 1277211 Ontario Inc. operating as Esplanada Restaurant & Café, 419 Barton Street East, Hamilton, L8L 2Y5, licence number 803758;
AND WHEREAS by letter dated April 19, 2007, Mr. Marini, counsel for the licensee, requested that the hearing be adjourned pending resolution of the issue between the licensee and the City of Hamilton;
AND WHEREAS the Board proposed to grant an adjournment on terms, which terms were consented to by Mr. Marini and Mr. Alton, counsel for the Registrar;
THEREFORE the Board hereby ORDERS as follows:
The hearing of this matter is adjourned sine die.
The licensee shall immediately cease all operations on the patio (no liquor
sale or service) pending resolution of its patio issue with the City of Hamilton.
The suspension of all liquor activity on the patio shall continue until this
matter before the Board, is resolved.
