O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on January 19, 2007 pursuant to a Notice of Proposal dated September 28, 2006 to suspend a licence issued to Balkanian Restaurant & Tavern Ltd. for premises operating as Poonam Restaurant, 2658 Danforth Ave., Toronto, Ontario, M4C 1L7, licence no. 802681.
AND WHEREAS in its decision of February 1, 2007, the Board found that the licensee had breached sections 31(1) (c) and 33 of Ontario Regulation 719/90;
AND WHEREAS the Board ordered a suspension of the liquor licence for five (5) days and requested that the licensee propose suspension dates;
AND WHEREAS the licensee has failed to propose suspension dates which are acceptable to the Board;
AND WHEREAS the Board reserves the right to impose suspension dates without further notice to the licensee;
THEREFORE the Board hereby ORDERS that the liquor licence issued to Balkanian Restaurant & Tavern Ltd. for premises operating as Poonam Restaurant, 2658 Danforth Ave., Toronto, Ontario, M4C 1L7, licence no. 802681 be SUSPENDED for FIVE (5) consecutive days to COMMENCE at 11a.m. on April 10, 2007 and continue until 2 a.m. on April 15, 2007.
